Online Purchase Terms and Conditions

This AGREEMENT is between James Hricko Architect LLC (JHA LLC) and the Purchaser who buys the house plan(s) using the online order form attached and incorporated herein by this reference. The Purchaser cannot resell, lend, loan, sublicense, assign or give away the plans or the limited license granted hereunder for the construction of one house to any third party. The license is limited to the Purchaser.

PURCHASE

Upon completion of the Purchaser online order form and successful processing of Purchaser payment, the house plan(s) identified on the online order form will be available for the Purchaser to download.

PAYMENT

Payment shall be made through Visa, or MasterCard. JHA LLC will charge the Purchaser’s credit card for the total amount set forth on the order form and all applicable taxes. All amounts are in U.S. dollars. No plans will be available for download until full payment has been received.

RETURN POLICY

Our plans may not be returned for credit or refund under any circumstances once the order has been processed. Please double check your selection carefully before placing your order. It is also very important that you check the dimensions of your lot or site, taking into account the zoning/building restriction lines (setbacks) before placing your order.

COPYRIGHT INFORMATION

When you purchase a set of plans, you are purchasing a license to build. This license gives you the right to construct one house from these drawings. To build the house more than once without express written permission, violates this copyright. By agreeing to these TERMS AND CONDITIONS, you are agreeing to abide by the copyright laws. Please read more information about copyright laws and the penalties involved for copyright violations here.

Ignorance of these laws or inadvertently violating them does not exempt the Purchaser and/or Builder from penalties. If you are interested in building a house multiple times, please contact us to inquire about our reuse fees.

BUILDING CODES

JHA LLC authorizes the use of our house plan(s) on the expressed condition that all local building codes, zoning requirements and other applicable laws, regulations, ordinances, and requirements are strictly complied with. Modifications may need to be made to your plans in order to comply with local requirements at Purchaser’s expense. It is the responsibility of the Purchaser of the JHA house plan(s) and/or the Builder to see that the structure is built to meet all the codes and requirements of their specific area. The Purchaser and/or the Builder hereby indemnifies and holds James Hricko Architect LLC, its principals, employees, and agents harmless from any claim, loss, or liability resulting from the failure of the plans to comply with local zoning laws or regulations or for any other breach of this Agreement attributable in whole or in part to Purchaser or its Builder.

WARRANTIES AND DISCLAIMERS

We have put substantial care and effort into the creation of the designs in this portfolio. However, since we cannot provide on-site consultation, construction observation and control over actual construction, and because of the great variance in local building requirements, building practices and soil, seismic, weather and other conditions, we make no warranty of any kind, express or implied with respect to the content or use of the house plans, including but not limited to any warranty of merchantability or of fitness for a particular purpose. The information, plans, and specifications contained in these documents are provided “as is” without warranty, either expressed or implied.

The plans in this portfolio have been prepared to meet or exceed generally accepted standards and practices and have been developed without knowledge of a specific site or geographical area. As such, supplemental to these drawings, it is the Purchaser’s and Builder’s responsibility to follow the material and equipment manufacturer’s published instructions, and to use accepted standards for each building trade. Topographic and subsurface conditions should be verified and foundations adapted accordingly. Prior to starting construction, the builder should check and be responsible for all dimensions and other details, and should review the drawings for compliance with the governing codes for the local area where the house is to be built. All structural, HVAC, and electrical requirements should also be reviewed prior to start of construction and is the responsibility of the Purchaser and Builder. Codes govern over drawings and dimensions govern over scale. The Purchaser should check with the local building official to determine if a professional stamp is required on the drawing to obtain a building permit. It is recommended that a local architect or engineer be retained to review and modify the drawings if necessary to ensure that the plans meet the above requirements. Any use of these construction drawings without regard to local codes, standards, site conditions, and other factors is at the Purchaser’s sole risk. JHA LLC assumes no responsibility for changes made to these drawings by others. The Purchaser agrees to defend and indemnify JHA LLC, its principals, employees, and agents for all claims, costs, losses, or damages resulting from the use of these house plans. 

JHA LLC authorizes the use of our drawings on the express condition that you comply with all local building codes, zoning requirements and other applicable laws, regulations and ordinances. 

JHA LLC assumes no liability or responsibility for errors or omissions in these pages or documents and reserves the right to make changes at any time. Actual house plans may vary in appearance slightly from 3D rendered images. The Purchaser and/or Builder is to verify all lot conditions and measurements before construction. The Purchaser is responsible for additional expenses incurred through meeting municipality requirements or other requirements for construction. Items, prices, term and conditions are subject to change without notice.

Architecture and design for commercial, residential, adaptive reuse, and historical spaces
